General Terms and Conditions of Sale (GTC) – Pocket MX

PREAMBLE

These General Terms and Conditions of Sale (hereinafter the "GTC") are concluded between SARL Pocket MX, hereinafter referred to as "the Seller", and any non-trading natural person, hereinafter referred to as "the Buyer", wishing to make a purchase on the website www.pocket-mx.com.

The GTC exclusively govern the contractual relationship between the Parties, from the order to after-sales service.
The Seller reserves the right to modify these GTC at any time. The applicable GTC are those in force on the date the order is validated.

ARTICLE 1 – SCOPE OF APPLICATION

These General Terms and Conditions of Sale apply to all sales concluded by SARL Pocket MX with non-professional buyers, for products offered for sale on the website www.pocket-mx.com, including in particular:

Electric mini quads for children, kids' buggies, electric balance bikes, electric cars for children, motorized leisure vehicles for children and teenagers, spare parts and accessories.

The products are offered while stocks last.
The photographs, visuals, and descriptions are provided for information purposes only and are not contractual.

These General Terms and Conditions of Sale are accessible at any time on the Site and prevail over any other version or conflicting document.

The validation of the order by the Buyer constitutes full and complete acceptance of these General Terms and Conditions of Sale.

ARTICLE 2 – ORDERS

2.1 Buyer Identification

To place an order, the Buyer must identify themselves via their email address and a password or create a customer account during their first order.
The Buyer is responsible for the accuracy of the information provided.

2.2 Order Validation

The order becomes final after:

  • cart validation
  • acceptance of the Terms and Conditions
  • choice of delivery method
  • payment validation

A confirmation email is sent to the Buyer.
The Seller reserves the right to block or cancel an order in case of non-payment, incorrect address, or previous dispute.

ARTICLE 3 – PRICES

Prices are indicated in euros including VAT and are those in effect at the time of the order.
No price may be modified after the order has been confirmed.

Specific orders may be subject to a quotation valid for 30 days.

ARTICLE 4 – PAYMENT TERMS

The accepted payment methods are:

  • Bank card (secure payment with 3D Secure)
  • Bank check payable to SARL Pocket MX
  • Payment in several installments without fees (according to the conditions displayed on the Site)

In the case of an order assisted by an advisor, a deposit of 30% may be required.

Any late payment will result in penalties of 5% of the total amount including tax, without prejudice to suspension or cancellation of the order.

ARTICLE 5 – DELIVERIES

Deliveries are made in mainland France and internationally according to the terms specified at the time of order.

Delivery is made to the doorstep of the residence or building, without installation or internal handling.

Lead times are given for information purposes only and may be extended between June 1st and September 1st (peak season).

The Buyer is required to check the condition of the package upon receipt and to make any reservations within 3 days.

ARTICLE 5 BIS – HIGH DEMAND

Certain products may be marked as "high demand," with a lead time of 40 to 60 working days.
Order validation constitutes acceptance of this lead time.

ARTICLE 5 TER – DELIVERIES OUTSIDE THE EUROPEAN UNION (INCOTERM DAP)

Deliveries outside the EU are made according to Incoterm DAP – Incoterms® 2020.
Customs duties, local taxes, and import formalities are exclusively the responsibility of the Buyer.

ARTICLE 5 QUATER – REFUSAL OF DELIVERY

Any unjustified refusal will result in the invoicing of:

  • the outbound/return transport
  • storage fees
  • administrative fees

No new shipment will be made until all fees are paid in full.

ARTICLE 5 QUINQUIES – PACKAGING AND RETURNS

The Buyer undertakes to keep the original packaging and pallets for 60 days.
All returns must be professionally packaged.
A return number (RMA) is mandatory before any return.

ARTICLE 6 – TRANSFER OF OWNERSHIP AND RISKS

The transfer of ownership and risks occurs upon acceptance of the order.
The products travel at the Buyer's risk.<

ARTICLE 7 – RIGHT OF WITHDRAWAL

In accordance with the law, the Buyer has 14 days to exercise their right of withdrawal.

Return costs are the responsibility of the Buyer.
A reduction may be applied in case of excessive use or depreciation of the product.

The refund will be made within 10 days after receipt and inspection of the product.

ARTICLE 8 – LEGAL WARRANTIES

The products benefit from:

  • the legal warranty of conformity
  • the warranty against hidden defects

Any request must be sent in writing to customer service.

ARTICLE 9 – RETENTION OF TITLE

The products remain the property of the Seller until full payment.

ARTICLE 10 – PERSONAL DATA

Data is processed in accordance with current regulations.
The Buyer has the right to access, rectify, and object.

ARTICLE 11 – INTELLECTUAL PROPERTY

All elements of the Site are protected.
Any reproduction is strictly prohibited.

ARTICLE 12 – APPLICABLE LAW

These Terms and Conditions are subject to French law.
The reference language is French.

ARTICLE 13 – DISPUTES

Any dispute falls under the jurisdiction of the French courts.

ARTICLE 14 – ACCEPTANCE

Any order placed on the Site constitutes unconditional acceptance of these Terms and Conditions.
